E-Smile Services N.V. considers careful and secure use of personal data important. As a financial services provider, we process a lot of sensitive data from our corporate clients and their customers (consumers and businesses). We inform you on this page what data we collect when you use our services, our app or when you visit our website. We also tell you why we collect this data.

Personal information we process.
E-Smile Services processes personal data of our customers and its representatives, customers of our customers, people who use our services, app and/or because you have provided this data to us yourself. Below is an overview of the personal data we may process from you, depending on the service used:
- first and last name;
- address;
- phone number;
- e-mail address;
- bank account number;
– IP-adress;
– internet browser en device type;
- Other personal data that you actively provide, for example by submitting an application on this website, in correspondence and by telephone.
Special and/or sensitive personal data we process.
Do you use an Electronic Money Service (EMS) from us?
Under the Money Laundering and Terrorist Financing Prevention Act (Wwft), we are required to process some additional data from your Legal Representative and/or Ultimate Interested Party (UBO). From these individuals we collect the:
- full name;
- date and place of birth;
- copy of proof of identification
Are you not using an EMS-sevice from E-Smile?
In that case, we do not process any special and/or sensitive personal data about you.
Users under the age of 16.
Our website and services are not intended to collect information about users who are under 16 years of age, unless they have written permission from their parents or guardian. However, we cannot verify whether a visitor is older than 16. We therefore recommend that parents be involved in their children's online activities in order to avoid collecting data about children without parental consent. If you believe that we have collected personal information about a minor without such consent, please contact us at privacy@e-smileservices.com so we can delete this information at once.
For what purpose and on what basis do we process personal data.
We process your personal data because it is necessary for delivering our services. Your data will be used for the following purposes:
- For the establishment of our customer relationship, in doing so we may receive data from third parties;
- To review your application;
- To handle your payment or transaction;
- To be able to deliver your ordered service (physical or digital);
- To protect your and our interests. This may include recording phone calls and chat sessions for training purposes, but also, for example, in the context of crime fighting and fraud investigations;
- When we are legally required to do so, for example, under the Financial Supervision Act (Wft) and Wwft, a request from the Police or the Surinaamsche Bank.
Automated decision-making.
E-Smile Services does not make decisions based on automated processing about matters that could (significantly) affect individuals. These are decisions made by computer programs or systems, without the presence of a human being (e.g. an employee of E-Smile Services).
How long and where do we store personal data?
As a financial institution, in many cases we are required by law to retain personal data for a number of years. In those cases, we do not retain your personal data longer than this mandatory statutory period. If there is no legal deadline, we will not keep your data longer than is strictly necessary to realize the purposes for which your data were collected. Your personal data will be stored and processed within the Netherlands and Suriname.
Access to personal data.
Access to personal data.Your personal data is only accessible within E-Smile Services by employees who need access to this data from their position. We do not sell your data to third parties and will only provide it to third parties if this is necessary for the execution of our agreement with you or to comply with a legal obligation. A processor agreement is in place with companies that process your data on our behalf to ensure the same level of security and confidentiality of your data. E-Smile Services remains responsible for this processing. We also have contractual arrangements with our clients as processors including a processor agreement.
Cookies, or similar techniques, that we use.
We use functional and analytical cookies. We do not use tracking cookies. A cookie is a small text file that is stored in the browser of your computer, tablet or smartphone the first time you visit this website. We use functional cookies to ensure that the website works properly and, among other things, to remember your preferences. During your first visit to our website, we have already informed you about these cookies and asked your permission to place them. You can opt out of cookies by setting your Internet browser to no longer store cookies. In addition, you can also delete any information previously stored through your browser settings. View, modify or delete data.
You have the right to view, correct or delete your personal data. In addition, you have the right to withdraw your possible consent to data processing or object to the processing of your personal data by us and you have the right to data portability. This means that you can submit a request to us to send the personal data we hold about you in a computer file to you or another organization named by you. You can send a request for inspection, correction, deletion, data transfer of your personal data or a request to withdraw your permission or objection to the processing of your personal data to privacy@e-smileservices.com. To make sure that the request for inspection is made by you, we ask you to send a copy of your ID with the request. In this copy, black out your passport photo, MRZ (machine readable zone, the strip of numbers at the bottom of the passport), passport number and Citizen Service Number (BSN). This is to protect your privacy. We will respond to your request as soon as possible, but within four weeks. We would also like to point out that you have the possibility to file a complaint with the national regulator, the Authority for Personal Data.
